RentRadar Privacy Policy + Owner Terms & Agreement

1. Definitions

• RentRadar / “we” / “us” / “our” means RentRadar.in, its affiliates and successors.
• User means any individual or entity using RentRadar services (tenants, browsers, property seekers).
• Owner means a property owner or landlord who lists property on RentRadar, either by direct submission or by aggregation (public sources).
• Listing Content means all materials submitted or collected by or for an Owner for display on RentRadar: photos, descriptions, contact info, floor plans, videos, etc.
• Open / Public Source means any source that is publicly accessible without restricted access: public portals, social media, public classifieds etc.
• Personal Data / Digital Personal Data has the meaning as per the India Digital Personal Data Protection Act, 2023 (DPDP Act), including any information about an identifiable individual collected or processed in digital form.
• Data Principal means the individual about whom personal data is processed.
• Data Fiduciary means RentRadar (or any person determining purpose & means of data processing) under DPDP.
• Third-Party / Processor means any external entity engaged by RentRadar to process data on its behalf (hosting, analytics, messaging etc.).

2. Nature of Services / Aggregation

RentRadar operates as a property listing aggregator and as a direct listing platform. We collect property listing data in two ways:

• Direct Submissions: Owners submit listing content to us directly.
• Aggregated Listings: We collect or display listings from public / open sources, where such content is publicly accessible or posted, subject to source permissions or applicable terms.

Owners may also post their properties elsewhere (other platforms, social media, classifieds). We show Listings on RentRadar to assist property seekers to find, compare, and contact owners.

3. What Data We Collect

From Users / Property-Seekers:

• Registration data: name, email, phone number, address, login credentials.
• Usage / technical data: IP address, device type, browser, timestamps, pages visited.

From Owners / Listing Content:

• Listing content (photos, descriptions, contact info, location, pricing etc.).
• Owner’s personal data: name, phone number, email etc. if provided.

From Aggregated Sources:

• Publicly available listing content: images, descriptions, contact info etc., subject to source terms.
• Third-party data when available from open sources.

Consent / Tracking / Cookies:

• Cookies, tracking technologies for functional, analytics, marketing purposes.
• Consent collected for non-essential cookies etc.

4. Legal Basis & Purpose of Processing

We process data under lawful bases required by the DPDP Act:

• Consent: for registration, owner listing content, communications, marketing, etc.
• Legitimate interests / necessary uses: operating platform, fraud prevention, service improvements, fulfilled in line with law.
• Compliance with legal obligation: responding to law enforcement, regulatory requirements.

Purposes include:

• Providing the search / listing service.
• Enabling users to contact Owners.
• Maintaining, improving, and personalizing the platform.
• Detecting fraud, misuse, security threats.

5. Owner Agreement / Owner Terms

These terms apply to Owners submitting content directly, or whose listings are aggregated.

Representations & Warranties

Owner represents, to the best of their knowledge, that:

• They own or have obtained all rights, permissions, or licenses necessary for the Listing Content submitted.
• The Listing Content does not knowingly infringe upon any third-party rights (copyright, trademark, privacy, or other proprietary rights).
• Owner does not represent or warrant that any content submitted is long free from dispute, nor that the listing cannot be disputed by others.

License Grant

Owner grants RentRadar a non-exclusive, royalty-free, worldwide, sublicensable license to use, display, reproduce, distribute, modify (if needed for display formatting), and sublicense their Listing Content for the operation of the RentRadar website/app, marketing, and promotional purposes.

Accuracy & Updates

Owner must ensure their listings are accurate and kept up to date. If property is rented, sold, or availability changes, Owner must update or notify RentRadar promptly.

Non-Exclusivity / Exclusivity

Unless an exclusivity agreement is separately made, Owner acknowledges non-exclusive listing is allowed, and that they may post the same content elsewhere.

Indemnification

Owner indemnifies and holds RentRadar harmless from any claims, damages, liabilities arising from breach of the above warranties (e.g. IP infringement, misleading content, violation of third-party terms).

6. Privacy / Intellectual Property / Disclaimers

• We are not responsible for verifying all listings from aggregated sources for accuracy, ownership or legality beyond reasonable diligence. Users are advised to verify property details and ownership contact before entering into transactions.
• If conflict arises between versions of a listing (e.g. in Price, availability) across platforms, the version provided directly by the Owner or most recently updated may be given preference.
• RentRadar disclaims liability for misrepresentation by Owners or errors from aggregated source data to the fullest extent permitted by law.

7. Data Processing, Storage & Security

• We implement standard technical and organizational security practices: encryption, access control, secure servers, staff training etc.
• Only authorised personnel/processors may access personal data.
• Contractual agreements in place with third-party processors to ensure confidentiality and compliance.

8. Cross-Border Data Transfers

• If any personal data is stored or processed outside India (e.g. cloud servers abroad), such transfers will only be performed under appropriate safeguards (contractual clauses, standard data protection standards), and in compliance with applicable law.
• Countries used for storage / processing are those that meet acceptable legal / security standards or where safeguards are in place.

9. Data Principal Rights

Users and Owners have the following rights (under DPDP):

• Access: know what personal data we hold about them, what is processed, shared etc.
• Correction / Update: request correction of inaccurate / incomplete data.
• Erasure (“Right to Delete”): request deletion of personal data when no longer needed or when consent is withdrawn, subject to legal obligations.
• Withdraw Consent: at any time for processing based on consent; upon withdrawal, we cease processing for that purpose.
• Grievance Redressal: lodge complaint via designated contact / Data Protection Officer.
• Agent / Guardian: for minors / persons unable to consent themselves, agent or guardian may exercise rights.

10. Children / Minors / Persons with Disability

• Service is not intended for children under 18. We do not knowingly collect personal data of children under 18. If we learn that we have collected such data, we will take steps to remove it.
• For any data from minors / persons lacking legal capacity, we require parental or guardian consent.

11. Cookies, Tracking & Profiling

• We use cookies / similar tracking technologies for essential functionality, analytics, performance, and (with consent) marketing.
• Non-essential cookies / tracking can be opted out by Users. Preference management / cookie consent banners will be provided.
• We do not use automatic profiling for decision-making that significantly affects Users without obtaining explicit consent.

12. Data Breach / Incident Response

In case of any personal data breach (unauthorized access, loss, disclosure etc.), we will:

• Investigate and contain breach.
• Notify affected Users / Owners “as soon as reasonably practicable” (and in any event within the legal timeframe if prescribed by law).
• Notify the Data Protection Board / regulatory authority, if required under DPDP.
• Take remedial measures to prevent recurrence.

13. Takedown / Dispute Resolution for Listing Content

• If a third party (or Owner) claims a listing or content is infringing, misused, reproduced without permission etc., they can submit a complaint/takedown request to info@rentradar.in
• We will investigate the complaint. If complaint is valid, remove or disable access to content; notify involved parties.
• Owner may also request removal of their listing at any time.

14. Policy Updates

We may update this Privacy Policy / Terms periodically. We will publish the revised version on the website.

15. Limitation of Liability & Governing Law

To the maximum extent permitted by law, RentRadar shall not be liable for any indirect, incidental, special or consequential damages arising from:

• Inaccurate or misleading listing content provided by Owners.
• Errors arising from aggregated content sourced from public sources.
• Any loss arising from reliance on listings without verifying personally.

Owner indemnifies RentRadar as described above.
